Program

The seminar will consist in 4 à 6 presentations concerning fundamental rights protection of citizens in the EU, in particular through the Charter of FR.

Fundamental rights protection in the EU is ensured at different levels and encompasses different sources of rights. Despite the efforts to ensure uniform human rights standards throughout the EU, the protection of fundamental rights in the Union remains fragmented.

At the EU level, the Charter of Fundamental Rights of the EU and the case law of the ECJ on general principles of EU law play an essential role in this protection. However, Member States’ obligations to comply with EU fundamental rights standards apply only in situations falling “within the scope” of EU law. Outside this scope the precise extent of which remains opaque, Member States’ fundamental rights standards are mainly subject to the requirements of the ECHR.

From a fundamental rights perspective, the legal situation of citizens in the EU is far from uniform. Both EU citizens and third country nationals can fall into a number of different categories depending on factors such as their mobility, their age, and other legal or factual circumstances. For the individual, the level of fundamental rights protection he or she enjoys in the EU context therefore varies.

The purpose of the seminar is to identify and discuss some of the challenges faced in connection with the fragmented nature of fundamental rights protection in the EU. The presentations will address the issue from different perspectives in order to get an overview.
